Children and Students

Who our service is for

Partiu accounts are meant for adults: graduating students 18 and over, parents, graduation companies, studios, and schools. Some events, such as elementary, middle, and high school graduations, include younger students. In those cases the organization running the event, or a parent, manages the student's information.

Children under 13 (COPPA)

We comply with the Children's Online Privacy Protection Act and the FTC's COPPA Rule (16 C.F.R. Part 312).

• We do not knowingly let children under 13 create their own accounts, and our sign-up flows ask for an adult.
• When a school or a parent adds information about a child under 13 (for example, a name in a class list or photos in an event gallery), we collect it only with verifiable parental consent, or, where the FTC allows, with the consent of the school acting for parents and only for the school's educational purpose.
• We collect only what the activity reasonably needs. We never condition a child's participation on giving more information than necessary.
• We do not show behavioral advertising to anyone, and we never use a child's information for advertising or sell it.
• Facial recognition stays off for children unless a parent or legal guardian gives written consent.
• We keep children's information only as long as needed for the purpose it was collected for, then delete it securely.

Parents' rights

A parent or legal guardian can review the personal information we hold about their child, ask us to delete it, and refuse to let us collect or use it further. Write to privacidade@partiuformatura.app or use the request form, choosing "A parent or legal guardian". We will verify that you are the parent before we share anything. If you believe we collected information from a child without consent, tell us and we will delete it promptly.

Teens 13 to 17

• We do not sell or share the personal information of anyone, including consumers under 16, so the opt-in consent that California and other states require for minors' data never comes into play.
• We do not use minors' data for targeted advertising or for profiling.
• Under California law (Bus. & Prof. Code § 22581), a registered user under 18 can ask us to remove content they posted publicly on our services.

Student records (FERPA)

When a school or school district uses Partiu, it may share information from students' education records with us under the Family Educational Rights and Privacy Act (20 U.S.C. § 1232g). In that case:

• We act as a "school official" with a legitimate educational interest, under the school's direct control regarding the use and maintenance of those records.
• We use the records only for the service the school contracted, and never re-disclose them without the school's authorization or a legal requirement.
• The school stays responsible for the records. Parents and eligible students exercise their FERPA rights (to inspect, correct, and consent to disclosure) through the school, and we help the school respond.
• We do not collect grades, transcripts, disciplinary records, or special-education information.

State student privacy laws

Many states restrict what education technology providers may do with student data, such as California's Student Online Personal Information Protection Act (SOPIPA) and similar laws in other states. Whether or not a given law applies to us, we follow their core rules for any student data we receive from a school:

• No targeted advertising based on student data, and no building profiles of students except for the school's purposes.
• No selling or renting student data.
• Reasonable security, and deletion when the school asks or when the contract ends.

Canada: minors

Under PIPEDA we get meaningful consent that a young person can understand, or the consent of a parent or guardian when they cannot. In Quebec, we collect personal information about a minor under 14 only with the consent of a parent or tutor, unless collecting it is clearly for the minor's benefit.
